Contractual Terms

  1. A 25% of the total balance in non-refundable deposit is required at acceptance of proposal. 50% at midpoint of job where midpoint is defined according to Triton Landscaping. The last 25% at completion of job according to Triton Landscaping.
  2. If a job is cancelled before completion, any deposit will be forfeit in its entirety. client will be responsible for all material, delivery, and dump costs. In the event of cancellation, Triton Landscaping charges a $100 fee per cubic yard for delivery or dump. This is on top of yard/landfill fees.
  3. In the event of cancellation, 50% of the total proposed cost will be due in addition to the above.
  4. Payments are due within 5 calendar days of each checkpoint, after which a $100 late fee will apply.
  5. Late payments will be charged at 2%/month compounded monthly. There is a NSF fee of $100 for bounced cheques.
  6. Any work involving materials provided by the client cannot be warrantied in any way.
  7. The proper identification and marking of irrigation lines falls under the purview of the homeowner. We will take care not to damage them but cannot make guarantees nor are liable. Repairs will be billed at $125 an hour plus materials.
  8. Any quote is valid for 30 calendar days upon issue.
  9. Realtors and Insurance quotes are subject to a $300 fee per estimate or quote.
  10. If during hand excavation, there is an excess of roots and/or rocks, the quote may change.
  11. Damages caused by owners’ negligence are not the responsibility of Triton Landscaping and may result in additional costs.
  12. The client agrees to accept the risk of damage to surfaces such as driveways, walkways, and patios from heavy machinery.
  13. By giving the go ahead with the proposal, the client agrees to all of these terms.
